Full Question: “When is the IR35 private sector roll out and is it actually going ahead?”
We feel your pain in the ‘will they, wont they’ saga that is IR35. As of April 2020 the plans to implement the IR35 roll out into the private sector has now been postponed until April 2021. This is due to the Covid-19 outbreak.
The now April 2021 roll out into the private sector means that the responsibility which was previously on the client to determine the contracts IR35 status, now lies with the end client/recruiter – ultimately whoever you sourced the contract role from. We were informed of further news on April 30th 2020 on the private sector roll out. With the proposed delay to IR35 many expected further information to be noted in the Finance Bill which is currently going through Parliament. Instead, it was pulled from the agenda.
In addition to this, the House of Lords Committee raised questionable doubt on the legislation itself, with the committee stating that the roll out was flawed and requires a major overhaul.
